So if hangovers are an illness, then the cure for a hangover should be considered medicine, right? Are government subsidized breakfast tacos and cheeseburgers in our future?

Not quite. Basically, the court wanted to put the kebash on an unnamed company selling bogus anti-hangover pills. But they couldn’t, because hangovers aren’t a legitimate illness. So they elevated the status of hangover to illness and now, the anti-hangover pills can’t claim to “cure” anything — only medicine can do that, and these pills are classified as food, not medicine.

“Information about a food product cannot ascribe any properties for preventing, treating or healing a human illness or give the impression of such a property,” the ruling said.

“By an illness, one should understand even small or temporary disruptions to the normal state or normal activity of the body.”

This, it said, includes the tiredness, nausea and headaches commonly associated with hangovers – and which the company, which was not named in the ruling, claimed its shots and powders could cure.
